  • The HPS series of Hydrogen generating systems qualify as “after-market products" as defined by the Magnuson-Moss Warranty Act,  and as designed will neither harm a vehicle nor void a vehicle warranty.

       Here is a short summary of the Magnuson-Moss Warranty Act:

The following is a typical HPS Warranty provided with each HPS Series Hydrogen Generator:

Warranty Statement & Information  
The Manufacturer (
Hydrogen Power Systems, HPS) provides the following warranty for all HPS Series Hydrogen Generator Systems.

A. 90 Day Unlimited Warranty, One Year Limited Warranty, Optional Extended Warranty

  1. Manufacturer (HPS) warrants to the end-user customer that all HPS products and their related components (Product) will be free from defects in materials and workmanship for one year from the date of installation. Extended warranty protection can be purchased at additional cost.
  2. This warranty does not cover HPS products that have been remanufactured, reverse-engineered, disassembled, modified, misused, improperly maintained or tampered with in any way after purchase.
  3. If a Product fails within the first 90 days of installation (and product installation complies with Section B of this warranty)  HPS will pay for the parts, labor and shipping required to bring the Product back into service. There are limits to shipping and labor reimbursements. These limits will be addressed and approved on a case-by-case basis.
  4. HPS's limited warranty covers only those defects that arise as a result of normal use of the Product and does not cover other problems, including but not limited to:
    1. Those that arise as a result of improper installation, maintenance or modification;
    2. The use of alternative parts or supplies not provided or supported by HPS;
    3. Operation outside the Product's specifications;
    4. Unauthorized modification or misuse.
  5. If Product failure or damage is attributable to the use of a non-HPS replacement part, HPS will charge its standard time and materials charges to service the Product for the particular failure or damage.
  6. If HPS receives, during the applicable warranty period, notice of a defect in any Product which is covered by this warranty, HPS shall either repair or replace the Product, at HPS 's option.
  7. If HPS is unable to repair or replace, as applicable, a defective product or component, which is covered by this warranty, HPS shall, within a reasonable time after being notified of the defect, refund the purchase price of the Product  as long as the defect is reported to HPS within the Warranty Period.
  8. HPS shall have no obligation to repair, replace, or refund until the customer returns the defective Product to HPS.
  9. Any replacement Product may be either new or like new, provided that it has functionality at least equal to that of the Product being replaced.
  10. HPS Products may contain remanufactured parts, components, or materials equivalent to new in performance.
  11. HPS 's Limited Warranty Statement is valid in any country where the covered Product is distributed by HPS. Contracts for additional warranty services, such as on-site service, may be available through authorized HPS service facility in countries where the Product is distributed by HPS or by an authorized importer.
  12. The expense of return postage or shipping from a customer to HPS shall be the responsibility of the customer. If applicable, HPS will pay postage or shipping costs to return a warranted replacement or repaired unit to the customer. Repaired Products will be returned to fulfill the remainder of the Product's original warranty duration.
  13. The HPS Hydrogen Generator Product is built to operate using only distilled water after an initial filling with the electrolyte solution provided by HPS in accordance with Instructions included with the Product. The use of substances other than distilled water, the approved HPS electrolyte solution, and the selected RV & Marine Antifreeze, is strictly prohibited and will void this warranty.

B. Product Installation

  1. HPS Products must be properly installed in order to function as designed. A qualified professional mechanic must perform the installation. Every effort has been made to provide detailed installation instructions and videos. These directions are provided with each Product and must be followed conscientiously to avoid installation errors that could cause a Product to malfunction. This warranty does not cover non-performance of Products improperly installed. The installer is responsible to the customer for proper Product installation and for correcting an improper installation.
  2. Components shipped with  HPS Products are warranted to perform as designed and are included in the warranty duration shown above. Defective components may be returned for immediate replacement anytime during the warranty period.
  3. In the unlikely event there are missing parts or components that should have been included in a Product installation kit, those missing parts or components will be shipped by same-day mail upon notification to HPS.
  4. All necessary parts and components required for routine installation according to the model purchased and the applicable vehicle have been included in each HPS Product installation kit. The cost of any extra wire, tubing, connectors or other miscellaneous parts and components required for an atypical installation is the responsibility of the customer.
  5. Products purchased from and installed by an authorized HPS distributor/agent are warranted by the distributor/agent in the same manner as a Product purchased directly from HPS, except customer complaints concerned with installation problems or Product defects must be processed by the distributor/agent who will then work with HPS to obtain replacement parts or repairs. The distributor/agent is solely responsible for correcting malfunctions due to improper installation.

C. Limitations of Warranty

  1. TO THE EXTENT ALLOWED BY LOCAL LAW, NEITHER HPS NOR ITS THIRD PARTY SUPPLIERS MAKE ANY OTHER WARRANTY OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, AND FITNESS FOR A PARTICULAR PURPOSE. ACCIDENTAL DAMAGES TO A CUSTOMER VEHICLE DURING THE INSTALLATION PROCESS, IS NOT COVERED BY THIS WARRANTY.

D. Limitations of Liability

  1. To the extent allowed by local law, the remedies provided in this Warranty Statement are the customer's sole and exclusive remedies.
  2. TO THE EXTENT ALLOWED BY LOCAL LAW, EXCEPT FOR THE OBLIGATIONS SPECIFICALLY SET FORTH IN THIS WARRANTY STATEMENT, IN NO EVENT SHALL HPS  OR ITS THIRD PARTY SUPPLIERS BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

E. Local Law

  1. This Warranty Statement gives the customer specific legal rights. The customer may also have other rights, which vary from state to state in the United States, from province to province in Canada, and from country to country elsewhere in the world.
  2. To the extent that this Warranty Statement is inconsistent with local law, this Warranty Statement shall be deemed modified to be consistent with such local law. Under such local law, certain disclaimers and limitations of this Warranty Statement may not apply to the customer. For example, some states in the United States, as well as some governments outside the United States (including provinces in Canada), may preclude the disclaimers and limitations in this Warranty Statement from limiting the statutory rights of a consumer (e.g., the United Kingdom); otherwise restrict the ability of a manufacturer to enforce such disclaimers or limitations; or grant the customer additional warranty rights, specify the duration of implied warranties which the manufacturer cannot disclaim, or allow limitations on the duration of implied warranties.
  3. THE TERMS IN THIS WARRANTY STATEMENT, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT, OR MODIFY, AND ARE IN ADDITION TO, THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF HPS PRODUCTS TO SUCH CUSTOMERS.
